
Confidential Employee - Bargaining Unit Status
A position is identified as a confidential position due to the nature of
job responsibilities which give the employee potential access to information
subject to use by the employer in negotiating and/or access to information that
raises a conflict of interest with other bargaining unit employees.
Therefore, the position is exempt from coverage by the AFSCME Collective
Bargaining Agreement. A
confidential employee cannot be a member of the union and cannot pay dues to the
union.
A confidential employee is paid on the same pay grade and receives the
same health insurance benefits as AFSCME bargaining unit employees in the same
classification.
A confidential position is covered by the provisions of the State Board
of Regents Merit System Rules. Both
organized and non-organized board of Regents merit employees may apply and
compete for this position as promotion, demotion, or transfer applicants.

Employees in confidential
positions will not accrue AFSCME seniority credit.
